Good News For Former Brocade CEO

December 9, 2007 · Leave a Comment

Fortune’s Roger Parloff reported Friday at his Legal Pad blog on a significant recent development in the options backdating case of former Brocade CEO Gregory Reyes. Although he was convicted on 10 bacdating related charges, Reyes will likely receive a minimal prison term – if he in fact is sentenced to any prison time at all. Seems the judge presiding over Reyes’ trial has concluded that Reyes’ conduct caused no economic losses, notwithstanding the Government’s assertions that Reyes caused as much as $2.5 to 3 billion. The Court rejected the Government’s various loss calculations as unproven or having no basis in fact or law. Thank Heaven we have the feds to protect us from all those non-loss causers.

“The whole thing is a crock of sh*t.”

So says defense attorney Mark Geragos about the federal investigation into steroid use and distribution that led to the recent indictment of home run king Barry Bonds. As outlined fairly persuasively in this recent article on Reason magazine’s website, Geragos appears to be right. The BALCO case appears to be yet another federal boondoggle in which the jack booted thugs prosecution feels compelled to justify having wasted years and millions dollars of tax payers money by indicting someon=e who committed no real crime fora derivative offense of perjury and obstruction in connection with the original fruitless investigation. Barry Bonds may be an unlikeable jackass. But that by no means excuses the ourageous lengths to which federal prosecutors have gone to vindicate this ridiculous investigation.

I guess the biggest news in this piece is the confirmation that the gal had a boob job. I mean, the fact that the feds want to stick their noses in isn’t a surprise. In any event, you can read the Daily News story in toto beneath the fold. (more…)

“The rumors of my death have been greatly exaggerated.”

December 8, 2007 · Leave a Comment

Its been brought to my attention (thanks, Bennett!) that I have been AWOL here for a while. I will confess I did not realize it had been so long since I’d posted here. Be assured, I’m still here, and the blog is alive. Just dealing with a major work crunch, and re-charging a bit. I’ll be starting back up with new posts shortly. In the meantime, can someone remid me why Barry Bonds lying about whether or not he took steroids needs to occupy the time of the federal government? I’ll give you a hint – its a trick question.
